1. License

The Software is licensed, not sold. The Owner grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license to use one copy of the Software for your personal, non-commercial use on a single device. The rights granted herein are subject to your compliance with this EULA. You hereby acknowledge that no title or ownership in the Software is being transferred or assigned, and this EULA is not to be construed as a sale of any rights in the Software.

2. Restrictions of Use

Unless the Owner has authorized you to distribute the Software, you shall not make or distribute copies of the Software or transfer the Software from one device to another. You shall not decompile, reverse engineer, disassemble, include in other software, translate the Software, or use the Software for any commercial purposes. You shall not modify, alter, or create derivative works based upon the Software. You shall not rent, lease, resell, sub-license, assign, or otherwise transfer the Software or this license. Any attempt to do so shall be void and of no effect.

3. Copyright

You acknowledge that no title to the intellectual property in the Software is transferred to you. Title and full ownership rights to the Software remain the exclusive property of Habitics s.r.o. You shall not remove or obscure the Owner’s copyright, trademark, or other proprietary notices from any materials contained in the Nutrilio package or downloaded with the Software.

4. Disclaimer of Warranty

The Software is provided “AS IS”, without warranty of any kind. We disclaim all express or implied warranties, specifically disclaiming the warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. The entire risk as to the quality and performance of the Software is with you. We do not warrant that the functions contained in the Software will meet your requirements or that the operation of the Software will be error-free.

5. Limitation of Liability

In no event will the Owner be liable for special, incidental, or consequential damages resulting from possession, access, use, or malfunction of the Software, including but not limited to damages to property, loss of goodwill, device malfunction, or, to the extent permitted by law, damages for personal injuries, lost profits, or punitive damages. This applies to all causes of action related to this EULA, including Subscriptions and One-Time Purchases.

For One-Time Purchases, the Owner’s liability shall not exceed the actual price paid for the purchase. For Subscriptions, the Owner’s liability shall not exceed the subscription fees paid for the most recent subscription period.

6. Privacy and Advertising

You can find our Privacy Policy on our website or within the Nutrilio application. It is advised that you read it in its entirety.

7. Indemnity

You agree to indemnify and hold the Owner harmless from and against any and all damages, losses, and expenses arising directly or indirectly from: (i) your acts or omissions in using the Software; or (ii) your breach of this EULA.

8. Updates and Modifications

The Owner may, from time to time, release updates or modifications to Nutrilio which may add, modify, or remove features. By using the Software, you agree to accept and install updates as required. The Owner reserves the right to discontinue or modify features, including those tied to One-Time Purchases, due to technical, legal, or business requirements. Such modifications do not entitle users to refunds unless required by law.

9. Medical Disclaimer

The Software is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health providers with any questions you may have regarding a medical condition or dietary changes. Never disregard professional medical advice or delay in seeking it because of something you have seen in this Software.

10. Subscriptions and One-Time Purchases

Subscriptions

• Free Version: Provides limited access for an unlimited time.
• Free Trial: Provides unlimited access for a limited duration.
• Paid Subscription (“Plus Version”): A fee-based program granting access to extra content. Access is only maintained while the subscription is active.

Purchases made through the Apple App Store or Google Play Store are final. These transactions are subject to the respective platform's payment policies, which generally do not provide refunds. Monthly subscriptions renew automatically unless canceled before the next billing cycle. Yearly subscriptions are paid upfront and renew annually.

One-Time Purchases

One-Time Purchases grant access for a duration not limited by a specific time, subject to reasonable use. These are non-refundable, tied to the user's account, and valid as long as the Software remains operational and supported.

11. Application Content

The content of Nutrilio can be evaluated during the Free Trial or the refund period provided by Marketplace Partners. If you continue using the Product without canceling the Trial, you will be responsible for the purchase, and the content itself will not be a reason for subsequent compensation.

At our sole discretion, we reserve the right to modify or replace these Terms at any time. Any future changes will be posted on this page. You should check this page periodically to take note of any changes.
